We Can Do Better at Managing Land Use Controls

Here’s the issue: Who is responsible for tracking, maintaining, and verifying the long-term presence of land use controls (LUCs)? There are implied obligations for the key stakeholders in a property transaction that need clarification and consistency of application, especially in the face of state and federal staffing and budget pressures.
Managing LUCs is one of the “next generation” issues for brownfields. These new issues are being identified as the rush to conclude cleanups under state voluntary cleanup programs continues.

Many initiatives have been considered during the last few years, but there are no consistent and widespread approaches. There were at least 11 sessions at the Denver Brownfields 2005 conference that dealt with LUCs. Initiatives can be grouped into administrative, legal and technical tools.
